Abstract

The goal of this work is to proppose the usage of Foucault’s and, in a lesser degree, Deleuze’s methodology in order to analyze and to explain the human right’s and its jurisdictional protection discourse, in terms of domination and of exercise of power. This has as its goal, not only to disagree with the legal dominant theory (which is always at some extent pleasant), but also to enable the creation of a ground from which a critique of the foundations of contemporary Law legitimation, which constitutes the first step in the search of a more including redetermination of the legal.
