¿Cómo piensan los jueces?

Abstract

In the present article, the author concentrates herself in the category of legal experience and approaches the judicial decisions like social actions. In this act of interpretation and application of the law, the judges use two types of knowledge: the properly legal and denominated one as “heap of knowledge at the hand”. It brings back to consciousness legal of each judge is the sum of these knowledge, which serve like pedagogical instrument to determine the sense of the legal practice.
