Abstract

The changes in the structure of the Brazilian State to invite a review of the guarantees of fundamental rights. Individual rights have been the center of the controversy surrounding the relationship between the Company and the State, always looking for a balance between the fact of state power and permanence of the citizen's rights, based on the idea of an open catalog individual guarantees, enabling activities and state case law, effectively linking the material of the Constitution to the realization of fundamental rights.
