Abstract

Common law is a normative system based on the memory. So ancestral memory that no one human is able to remember, only the language manages to recreate those old traditions that are taken with fervor of religious dogma. Common law is in a war without quarter against the history of the daily life, the speech of common law supports to the tradition and the language, language that in intense prose and phonetic repetitions, recreating ancestral situations. It is a movable right, a domesticated right, a right of masks. The government tries to have a law of images, a law of signs. Mnemotecnic is the weapon of the government, the hermeneutic its simple survival.
