Evolution of sanctions for non-compliance with amparo rulings
Main Article Content
Abstract
Coerciveness is an essential element of legal norms; without it, the provisions contained in the norm do not have the force of law and are therefore not enforceable. In this sense, this work seeks to explain to the reader how, in the Mexican case, the coercive nature of amparo proceedings came to be implemented, within a complicated social context. Where the judiciary had to fight to enforce its own rulings and assert itself as one of the three branches of government, even over the interests of the military itself. Likewise, the sanctions currently in force in the Amparo Law against all responsible authorities who fail to comply with these rulings are analyzed, as well as the special procedure that must be enforced to criminally prosecute public servants who, in their capacity as responsible parties, commit these illegal acts.
