Abstract

In the process for exercising legal capacity for adults with disabilities, the family court judges of Mazatlán, Sinaloa, by international provision, require that in these types of trials a support assessment report prepared by a social worker be attached to the complaint. This requirement is unknown to both lawyers and people with disabilities and their families. When the judge requests it, they face the problem of ignorance: what it is, and who can request the support assessment report. The objective of the research was to understand what the support assessment report is for exercising legal capacity for older adults with disabilities, the role of the social worker in this process, and the role of the family as support persons in this case. A qualitative approach was adopted for the research, employing semi-structured interviews with social workers to explore their experience on the
subject. The results show that there is little knowledge and experience in these processes, both among social workers and among the families of people with disabilities.
