Tratados bilaterales de inversión y reestructuración de deudas soberanas

Resumen

De manera creciente los tenedores de deuda soberana recurren a los tratados bilaterales de inversiones (TBIs) para controvertir los acuerdos de reestructuración de deudas soberanas en procesos arbitrales. Este artículo estudia críticamente las implicaciones de este fenómeno desde la perspectiva colectiva de los procesos de reestructuración. Para ello se analiza cómo los TBIs y los estándares referentes a las inversiones extranjeras se están utilizando o podrían utilizarse para resolver las controversias relativas a la deuda soberana, así como los problemas económicos y de derechos humanos que suscita la opción del arbitraje que se derivan del uso de los TBIs para controvertir reestructuraciones de deuda soberana.

Juan Pablo Bohoslavsky, Universidad Nacional de Río Negro

Investigador del Consejo Nacional de Investigaciones Científicas y Técnicas (CONICET) y Universidad Nacional de Río Negro (Centro Interdisciplinario de Estudios sobre Derechos, Inclusión y Sociedad, CIEDIS). Entre 2014 y 2020 fue Experto Independiente en Deuda y Derechos Humanos de la ONU.  Este artículo actualiza el informe temático que el autor presentara en 2017 ante la Asamblea General de la ONU, UN Doc. A/72/153.
